AI vocals and voice cloning: what's allowed in music

AI vocals that don't sound like anyone in particular are allowed almost everywhere. A voice that imitates a real artist is where platforms, distributors and lawmakers draw the line. This is general information as of October 2026, not legal advice.

Streaming services

Spotify's policy is short: vocal impersonation is only allowed when the impersonated artist has authorised it. It also tests ways to stop uploads to other artists' profiles. YouTube asks creators to disclose cloned voices as synthetic content and has a separate impersonation policy.

Distributors

DistroKid's AI rules say your music can't mimic someone else's voice, likeness or identity without permission, and other distributors that accept AI music have similar bans on imitating real artists. A soundalike release can be taken down even if the tool let you make it.

The law

  • •United States: Tennessee's ELVIS Act, in force since July 2024, protects a person's voice, including a simulation of it, as part of their right of publicity. Other states have similar laws, and the federal NO FAKES Act has been proposed but wasn't law when we checked.
  • •European Union: from 2 August 2026, Article 50 of the AI Act requires anyone publishing a deep fake, including audio that resembles a real person, to disclose that it's artificially generated. For evidently artistic or creative works, the duty is limited to disclosing it in a way that doesn't spoil the work.
  • •Everywhere: using someone's name to promote a soundalike track adds trademark and passing-off risk on top.

Safe ways to use AI vocals

  • •Generic AI voices that don't imitate a specific singer
  • •Your own voice, cloned with your own consent
  • •A singer who has agreed in writing to a voice model, with the terms written down
  • •No artist names in your prompts, titles, tags or descriptions
  • •Disclose the AI vocal in your distributor's AI credits and on YouTube

Frequently asked questions

Can I release a song with an AI voice that sounds like a famous singer?

Not without that singer's permission. Spotify only allows vocal impersonation the artist has authorised, distributors ban it and US voice laws such as the ELVIS Act can apply.

Can I clone my own voice?

Yes, a clone of your own voice made with your consent isn't impersonation. Disclose the AI vocal where platforms ask.

Do I have to label AI vocals in the EU?

If the vocal resembles a real person, Article 50 of the EU AI Act requires disclosure from 2 August 2026, in a light form for artistic works. Generic AI voices still fall under platform disclosure rules.
