DMCA Policy

Textlino respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our Service.

1. How Our Service Works

Textlino generates original text content using AI based on user-provided prompts. The AI creates new text and does not intentionally copy or reproduce existing copyrighted works. However, we acknowledge that AI-generated content may occasionally resemble existing material.

2. Filing a DMCA Takedown Notice

If you believe that content generated or hosted through Textlino infringes your copyright, you may submit a written DMCA notification to our designated agent. Your notice must include:

  1. Identification of the copyrighted work — Describe the copyrighted work you claim has been infringed, or if multiple works are involved, a representative list.
  2. Identification of the infringing material — Describe where on our Service the allegedly infringing material is located, with enough detail for us to find it (e.g., specific URL or description of content).
  3. Your contact information — Include your full name, mailing address, telephone number, and email address.
  4. Statement of good faith belief — A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy — A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  6. Your signature — A physical or electronic signature of the copyright owner or authorized representative.

4. What Happens After Filing

Upon receiving a valid DMCA notice, we will:

  1. Acknowledge receipt of your notice within 2 business days.
  2. Investigate the claim and identify the relevant content or user account.
  3. If the claim is valid, remove or disable access to the infringing material promptly.
  4. Notify the user whose content was affected (if applicable), providing them with a copy of the notice and information about filing a counter-notice.

5. Counter-Notification

If you are a Textlino user and believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification containing:

  1. Identification of the material that was removed and the location where it appeared before removal.
  2. A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification.
  3. Your name, address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the federal court in your district (or, if outside the US, the jurisdiction of courts applicable to Textlino's operator), and that you will accept service of process from the person who submitted the original notice.
  5. Your physical or electronic signature.

In accordance with the DMCA, we maintain a policy of terminating the accounts of users who are determined to be repeat infringers in appropriate circumstances.

7. Important Note About AI-Generated Content

Because Textlino generates text using AI models, the content is created algorithmically and not copied from a database of existing works. If two pieces of text are similar, it may be coincidental rather than intentional infringement. We will evaluate each claim on its merits.

8. Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including attorney's fees. Please ensure your claim is legitimate before filing.
